Project outline

ESL received an instruction relating to a new store at Whaley Bridge, which required the installation of an IDNO/DNO shared Substation and High Voltage (HV) / Low Voltage (LV) Cabling.

The Substation itself, and the HV cables fell into third party land owned by an adjacent competing supermarket.

How we did it

The Substation and the associated Rights for Cables and Access were secured under the Incorporated Rights process, and ESL also looked to involve the third party in a Tripartite Agreement. With legal history between the two parties, this was likely to prove difficult. Part of the access route was also crossing unregistered land, and this would’ve needed an Indemnity Policy. However, following further investigation, the landowner held their own Policy that was sufficient for the IDNO and DNO to rely upon.

Key outcomes

Due to the complexities of this project, there were many processes that our project manager needed to undertake to ensure sufficient Rights were secured, as quickly as reasonably possible. Responsible for negotiation between so many parties, ESL balanced the landowner's urgent need for a supply with the Statutory Undertaker’s needs to ensure adequate Rights, with clear and regular communication.
